Division 1. CONTROLLED SUBSTANCES |
§ 38-11-1. Definitions.
For purposes of this division, the following words and phrases shall have the meaning respectively ascribed to them by this section:
Controlled substance means any drug, immediate precursor or substance, by whatever official, common, usual, chemical, or trade name known, that is delineated in Schedules 1 through 5 of Part 72 of the Michigan Public Health Code, being MCL 333.7201 through MCL 333.7231; MSA 14.15(7201) through 14.15(7231).
Drug means:
(1)
A substance that is recognized as a drug in the official United States Pharmacopoeia, official homeopathic Pharmacopoeia of the United States, or official national formulary, or any supplement to any of them; or
(2)
A substance that is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in human beings or animals; or
(3)
A substance, other than food, that is intended to affect the structure or function of the body of human beings or animals; or
(4)
A substance that is intended for use as a component of any substance specified within this definition.
Identification card means a card that is issued by an authorized provider which (1) permits the staff and volunteers of a needle-exchange program to pick up from, and distribute hypodermic syringes or needles to, participants in a needle-exchange program, and (2) permits the participants in a needle-exchange program to possess hypodermic syringes or needles.
Immediate precursor means a substance which the Michigan Board of Pharmacy, or its designated or established authority, has found to be and by rule designates as being the principal compound commonly used or produced primarily for use, and which is an immediate chemical intermediary used or likely to be used in the manufacture of a controlled substance, the control of which is necessary to prevent, curtail, or limit manufacture.
Prescription form means a printed form which is authorized and intended for use by a prescribing practitioner to prescribe a controlled substance or a prescription drug and which meets the requirements of rules promulgated by the Michigan Board of Pharmacy, or its designated or established authority.
