§ 38-11-5. Fraud and deceit in obtaining controlled substances by, and unauthorized use of, a prescription form prohibited.

  • (a)

    Any fraud, deceit, misrepresentation, subterfuge, or concealment of a material fact, including providing a false name or a false address for the purpose of obtaining any controlled substance or providing a false statement on any prescription form, shall be deemed a violation of this division.

    (b)

    A person who has obtained the possession of any controlled substance shall not use the same, or permit or authorize its use, for any purpose other than that specifically provided for by the prescription form.
