§ 38-11-27. Fraud and deceit in obtaining hypodermic syringes or needles by, and unauthorized use of, a prescription form prohibited.

  • (a)

    Any fraud, deceit, misrepresentation, subterfuge, or concealment of a material fact, including providing a false name or a false address for the purpose of obtaining any hypodermic syringe or needle or other instrument or implement or providing a false statement upon any prescription form, shall be deemed a violation of this division.

    (b)

    A person who has obtained the possession of any hypodermic syringe, needle, or other instrument shall not use or alter the same, or permit or authorize its use or alteration for any purpose other than that specifically provided for by the prescription form.
