§ 2-6-121. Authority; contents thereof; procedure; notice to public servant, contractor, or vendor.
(a)
The board of ethics is authorized to conduct investigations, on its own initiative, regarding a board member's perceived violation of the disclosure requirements that are found in Division 2 of this article, or the standards of conduct that are found in Division 3 of this article.
(b)
An investigation may be initiated by a member of the board who raises the matter at a board meeting, but, in order for the investigation to proceed, the board must approve the investigation at the same or subsequent board meeting, by a three-fourths (¾th) vote of board members serving.
(c)
Where the board initiates an investigation, the public servant, contractor, or vendor who is the subject of the investigation shall be sent, via first class and certified mail, a written notice: 1) that an investigation has been authorized and is taking place, and 2) which contains a summary of the basis for the possible violation(s).
