§ 4-1-2. Responsibilities of airport department.
The powers and duties of the airport department shall be exercised and performed as provided in this section and in accordance with the general laws of the United States and this state, the rules and regulations of the Federal Aviation Administration and the state department of aeronautics and the Charter, this Code and other ordinances of the city. Such powers and duties shall be as follows:
(1)
The department shall acquire and hold airports, heliports, seaplane bases, landing fields or sites and any other aeronautical facilities in the name of the city.
(2)
The department shall plan, construct, improve and operate airports, heliports, seaplane bases, landing fields and sites and other aeronautical facilities within the territorial limits of the city or within or without the state.
(3)
The department shall represent the city in all aviation matters affecting the interests of the city.
(4)
The department shall have supervision, manage and control all city properties and equipment devoted to aviation activities, both as to supervision, maintenance and operation.
(5)
The department may, with the approval of the city council, in the name of the city, take and hold by purchase, gift, devise, bequest or otherwise such real and personal property as may be needed for carrying out the intent and purposes for which it is established.
(6)
The department shall recommend to the city council the institution of condemnation proceedings whenever in its judgment private property shall be taken in the name of the city for the purposes of the department.
(7)
The department may, with the approval of the city council, sell and convey or lease any of the buildings or land under its control whenever required by the interests of the city.
(8)
The department may make, with the approval of the city council, all contracts or leases necessary to carry out the objects and purposes of the department, as provided in this section.
(9)
The department shall adopt and amend all needful rules and regulations for the management, government and use of any properties under its control, whether within or without its territorial limits.
(10)
The department may recommend the enactment of ordinances designed to safeguard the public upon or beyond the limits of public or private airports, heliports, seaplane bases, landing fields or sites or other aeronautical facilities within the city or its police jurisdiction against the perils and hazards attendant to the operation of aircraft and aeronautical facilities, which ordinances shall not be inconsistent with the laws of the federal government and this state or the rules and regulations of the Federal Aviation Administration or the state department of aeronautics.
(11)
The department may request such assistance as may be reasonably necessary from other city departments in the performance of its duties.
(12)
The department shall have the power and authority to specifically delegate any part or all of its power and authority to any person employed in the department for the accomlishment of the duties with which the department is charged.
