§ 38-11-26. Sale and dispensing of hypodermic syringes or needles prohibited.
It shall be unlawful to sell, furnish, supply or give away to any person any hypodermic syringe or needle, or other instrument or implement which may be adapted for the dispensing or use of any controlled substance by subcutaneous injection or intracutaneous injection, or any other manner or method of introduction into the human body, unless:
(1)
The person who is selling, furnishing, supplying or giving away said hypodermic syringe or needle, or other instrument or implement is licensed by the state; and
(2)
The person who is buying or receiving said hypodermic syringe or needle, or other instrument or implement, is in possession of a prescription form for such item; and
(3)
The prescription referred to in subsection (2) of this section is issued by a licensed medical doctor or osteopathic physician within the period of one (1) year prior to the purchase or receipt of said hypodermic syringe or needle, or other instrument or implement.
